(1) INTRODUCTION
These terms and conditions govern your use of our website; by using our website, you accept these terms and conditions in full, and you are agreeing to comply with and be bound by these terms and conditions of use, which together with our privacy policy and returns policy govern Allied Plumbing & Heating Ltd's relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use the website.
You must be at least 18 years of age to use our website. By using our website and by agreeing to these terms and conditions you warrant and represent that you are at least 18 years of age. Our website uses cookies. By using our website and agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of our privacy policy.
(2) ORDERING FROM US
You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process, you will be given the opportunity to check your order and correct any errors. We will send you an order acknowledgment, detailing the products you have ordered.
Our acceptance of an order takes place when we dispatch the order. We will send you a dispatch confirmation by email. When we dispatch the order the purchase contract will be made even if your payment has been processed immediately unless we have notified you that we do not accept your order or you have canceled your order.
We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorization for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.
Please note some of the parts are dispatched directly from our suppliers to speed up delivery and availability. Hence we may ask for returns to be sent back directly to the suppliers who dispatched the item to you. We will deal with all refunds directly with you.
Shortages/Damages/Incorrect Parts
Shortages/damages or incorrect parts supplied MUST be notified to us in writing within 48 hours of receipt. Failure to notify us within 48 hours of receipt will be deemed as having received your complete order.
(2.1) Trade Customers Only
Allied Plumbing & Heating Ltd supplies products strictly and exclusively to customers purchasing in the course of a business, trade, profession or occupation.
By placing an order through our website, you confirm and warrant that you are purchasing for business or trade purposes and not as a consumer.
The Company shall be entitled to rely upon the information, declarations and confirmations provided by the customer during checkout when determining whether a purchase is made for business or trade purposes.
We reserve the right to request additional information to verify the business status of any customer and may refuse, cancel or suspend any order where we reasonably believe the purchase is not being made for business or trade purposes.
Where a customer provides inaccurate, incomplete or misleading information regarding their business status, the Company shall not be responsible for any resulting loss, claim, cost or liability arising from reliance upon such information.
(2.2) Definition of Products
For the purposes of these Terms and Conditions, "Products" shall include, without limitation, boiler spares, central heating components, underfloor heating products, plumbing products, electrical components, controls, accessories, fittings, valves, pumps, pipework, wiring products and any other goods, equipment or products supplied by Allied Plumbing & Heating Ltd.
(3) PRICING & STOCK
ALL PRICES ARE SUBJECT TO 20% VAT.
Back Orders
If your item is not in stock, we will back order it for you. You will always be emailed with the option to cancel your order if you would rather not wait.
(4) PARTS IDENTIFICATION & SPECIFICATIONS
The manufacturer's part numbers & Images are used for reference purposes only.
It is the duty of the Buyer to order the correct part. The seller shall deliver the part ordered and accepts no responsibility for inaccurate advice supplied by a third party to the Buyer in the identification of the part required, whether through commercial recommendation or technical diagnosis.
(4.1) Drawings & Specification
The goods supplied are manufactured and supplied by different manufacturers and are made in accordance with their own Specifications and Design. Allied Plumbing & Heating Ltd cannot take responsibility for any loss or inconvenience caused by bad design or by any other manufacturing defects.
(4.2) Compatible Copy Parts
Some of the parts supplied by Allied Plumbing & Heating Ltd are marked as compatible copy parts. These parts are replacement parts not manufactured/supplied by the original equipment manufacturer. These parts would be supplied as in the photos. Most would not come with washers /gaskets/instructions. If you require the original part please e-mail for a quotation. We shall not be liable for any claim for work done by a buyer in respect of defective goods whatsoever arising directly or indirectly howsoever arising and whether consequential or otherwise.
(4.3) OEM, Genuine and Original Manufacturer Products
Where products are supplied as OEM, genuine, original manufacturer or manufacturer supplied products, Allied Plumbing & Heating Ltd does not manufacture such products and relies upon the specifications, descriptions, warranties and information supplied by the relevant manufacturer.
Any warranty claim relating to an OEM, genuine or original manufacturer product shall be subject to the warranty procedures and limitations contained in Clauses 8.2 to 8.7 of these Terms and Conditions.
Subject to Clause 9.1, Allied Plumbing & Heating Ltd shall not be liable for any labour costs, installation costs, removal costs, reinstallation costs, call-out charges, property damage, consequential losses, indirect losses or other expenses arising from any alleged defect, malfunction or failure of an OEM, genuine or original manufacturer product supplied.
(4.4) Product Compatibility and Technical Advice
The purchaser is solely responsible for ensuring that the product ordered is suitable, compatible and correct for its intended application, equipment or system.
If the purchaser is unsure whether a product is suitable, compatible, OEM, genuine, original manufacturer, replacement or equivalent for their requirements, they should contact Allied Plumbing & Heating Ltd by email at [email protected] before placing an order.
Whilst Allied Plumbing & Heating Ltd uses reasonable endeavours to maintain accurate product information, specifications, compatibility data, descriptions and images, manufacturers, suppliers or distributors may change products, specifications, packaging, model compatibility or part numbers without notice. As a result, information displayed on the website may not always reflect the most recent manufacturer information.
Subject to Clause 9.1, the Company shall not be liable for any loss, cost, expense, damage or claim arising from the purchaser's failure to verify compatibility or suitability before placing an order.
(5) LICENCE TO USE THE WEBSITE
Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved. You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.
You must not:
(a) Republish material from this website (including republication on another website);
(b) Sell, rent, or sub-license material from the website;
(c) Reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose;

(8.1) General Limited Warranties

All images are supplied for reference purposes only. All dimensions and capacities stated are approximate. Consistent with Allied Plumbing & Heating Ltd's policy of continual improvement, the right is reserved to amend product specifications without notice. (8.2) Parts Warranty
All parts supplied by Allied Plumbing & Heating Ltd come with a 6 month warranty unless otherwise stated. The warranty shall be that specified by the relevant manufacturer of the goods.
Any product found to be defective within the applicable warranty period will, at the Company's sole discretion, be repaired or replaced with an equivalent product, subject to the purchaser supplying reasonable evidence of purchase and any information reasonably required by the Company to assess the claim. No credit, refund or compensation shall be issued unless expressly agreed in writing by the Company.
Allied Plumbing & Heating Ltd shall not be responsible for any loss, damage, expense or liability arising from the faulty nature, failure, use or installation of any product supplied. The Company shall not be liable for any claim relating to labour charges, installation costs, removal costs, reinstallation costs, engineer attendance charges, call-out charges or work carried out by the purchaser or any third party in connection with defective goods, whether arising directly, indirectly, consequentially or otherwise. All warranty claims shall be subject to Clauses (8.3) to (8.7) of these Terms and Conditions.
(8.3) Product Inspection and Warranty Claims
Any alleged defect must be notified to the Company in writing immediately upon discovery and within the applicable warranty period. The Company reserves the right to require the return of the allegedly defective product for inspection and testing by the Company, the manufacturer, or an appointed third party.
The purchaser shall initially bear the cost of returning the product for inspection. If the product is verified by the manufacturer or Company to be genuinely defective, the Company will reimburse reasonable standard carriage costs.
No warranty claim shall be accepted unless the product is made available for inspection. The purchaser shall not dispose of, alter, repair, dismantle, or modify the product before such inspection has been completed. The Company reserves the right to reject any warranty claim where the product has not been made available for inspection or where the purchaser has failed to provide reasonable evidence in support of the claim.
(8.4) Exclusive Remedy
Where a product is found to be defective within the applicable warranty period, the purchaser's sole and exclusive remedy shall be repair or replacement of the product, at the Company's sole discretion. No refund, compensation, damages, reimbursement, labour costs, consequential losses, indirect losses, or other remedy shall be available unless expressly agreed in writing by the Company.
(8.5) Installation, Suitability and Use
The purchaser is solely responsible for ensuring that the product is suitable for its intended application and is installed, commissioned, operated, serviced, and maintained by an appropriately qualified, competent and, where required by law, appropriately registered professional (including, where applicable, an active Gas Safe registered engineer).
The Company accepts no liability whatsoever for any loss, damage, cost, or expense arising from incorrect installation, incorrect commissioning, misuse, abuse, neglect, modification, improper maintenance, freezing, contamination, excessive pressure, electrical faults, system defects, incompatibility with existing equipment, failure to follow manufacturer instructions, or any other cause beyond the Company's reasonable control.
(8.6) Exclusion of Property Damage Claims
Subject to Clause (9.1) and to the fullest extent permitted by law, the Company shall not be liable for any damage to property, buildings, fixtures, fittings, boilers, heating systems, hot water systems, pipework, ceilings, walls, floors, decorations, equipment, stock, or any other property arising directly or indirectly from the installation, use, malfunction, failure, or alleged failure of any product supplied.
(8.7) Labour and Associated Costs
Subject to Clause (9.1), the Company shall not be liable for any labour charges, installation costs, removal costs, reinstallation costs, engineer attendance charges, diagnostic costs, inspection costs, call-out charges, transport costs, accommodation costs, administrative costs, or any other expenses incurred in connection with the inspection, removal, replacement, repair, or reinstallation of any product supplied.
(9) DISCLAIMER & LIMITATIONS OF LIABILITY
(9.1) Liability Which Cannot Be Excluded
Nothing in these Terms and Conditions shall exclude or limit liability for:
(a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation;
(c) any liability which cannot be excluded or limited under applicable English law; and
(d) any liability expressly stated elsewhere in these Terms and Conditions as not being excluded.
(9.2) General Limitation of Liability
Subject to Clause (9.1), and to the fullest extent permitted by UK law, neither Allied Plumbing & Heating Ltd nor any associated company shall be liable to you by reason of any representation, or any implied or expressed warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence, whether on the part of Allied Plumbing & Heating Ltd or any of its members, agents, directors, subcontractors, employees or otherwise, for any indirect, special or consequential loss or damage (including but not limited to loss of profit, loss of savings, costs, expenses or other claims for compensation whatsoever) arising out of or in connection with the use of our website, the supply of the products, or their use or resale by you.
The limitations of liability contained in these Terms and Conditions shall apply equally for the benefit of Allied Plumbing & Heating Ltd and any associated company, agent, affiliate, director, employee, subcontractor or representative of Allied Plumbing & Heating Ltd as if references to Allied Plumbing & Heating Ltd included references to each such person or entity.

Allied Plumbing & Heating Ltd shall not be liable to you, your agents or representatives, nor be deemed to be in breach of contract, by reason of any delay or failure in performing any obligation where such delay or failure results from circumstances beyond the reasonable control of Allied Plumbing & Heating Ltd.

Allied Plumbing & Heating Ltd may, at its sole discretion, assign, transfer or subcontract any of its rights or obligations under these Terms and Conditions to any third party or appointed agent.
